1. Overview
Cecil Jones Marketing, operated by Acquire, Inc. ("CJM," "we," "us," and "our") respects your privacy and is committed to protecting it through compliance with this Privacy Policy. This Privacy Policy describes how Personal Information is collected and used when visiting ceciljonesmarketing.net, communicating with the company, or when they otherwise process your Personal Information through the "Platform," except regarding their processor role.
This Privacy Policy does not apply to data subjects of customers whose Personal Information CJM receives through its services. Customers use the platform to store and process their own customers' Personal Information for activities like creating websites, offering products, sending communications, or otherwise processing data. In those cases, CJM acts as a processor and service provider. When data is given to a customer or collected on their behalf, our customer's privacy notice, rather than this Privacy Policy, will apply to processing.
Users are instructed not to use the Platform if they disagree with the policies. By accessing or using it, they agree and consent.
2. Information That CJM Collects About You
Information is collected:
- Directly from you when subscribing to newsletters, creating accounts, making purchases, or requesting information — including name, contact, billing, shipping, communication details, and account credentials. If you submit Personal Information about others, you are responsible for making sure that you have the authority to do so and to allow usage per this Privacy Policy.
- From third parties through marketing partners, vendors, suppliers, event hosts, public database providers, or research partners. This may include name, contact details, professional information, and publicly available content.
- Automatically when you use the Platform, collecting device information like IP address, interaction data, and through cookies, pixel tags, and similar technologies. A separate Cookies Policy applies.
3. How CJM Uses Information It Collects About You
Purposes include:
- Functionality and Development: to provide, offer, personalize, and improve the Platform; measure usage; diagnose server problems; provide security; perform data analysis; generate updates and reports; and check proper functioning. Update functions may automatically check your system to refresh or modernize files for security and features.
- AI Features: AI tools may enhance performance capabilities. We do not use your Personal Information to train generalized, public AI models. Specialized AI subprocessors are limited to providing the specific service being used.
- Customer Support: to provide support for the Platform.
- Business Operations: for accounting, auditing, billing, reconciliation, collection, and contractual obligations.
- Communication: sending messages about the Platform and accounts, customer service responses, alerts like security updates, and marketing materials per communication preferences.
- Protect and Secure: crime or fraud monitoring and prevention, cybersecurity.
- Advertising and Marketing: using Personal Information about advertisements viewed and other collected data to provide personalized content, verify eligibility for promotional offers, engage in targeted advertising, and study campaign effectiveness — including data from the affiliate referral program.
- Statistical Purposes: compiling Platform statistics into traffic reports to understand and respond to user needs.
- Legal, Regulatory, and Compliance: complying with legal obligations and protecting legal rights.
Legal Basis for Our Use: Certain data protection laws require identifying a valid legal basis before processing Personal Information. CJM collects Personal Information only with consent, when needed to perform a contract, when there is a legal obligation, or when processing is in legitimate interests — such as processing for administrative purposes, direct marketing, product development or improvement, and preventing fraud.
If information is required by law or contract, it will be made clear at collection, including whether it is mandatory and consequences of not providing it. For legitimate interests, we will take reasonable steps to provide clear notice and describe those interests.
CJM is the Data Controller for Personal Information collected through the Platform in the EEA and UK, except for Processor Services or where a supplemental policy says otherwise. Contact details are in the "How to Contact Us" section.
4. How CJM Protects Your Information
The Platform is designed to provide reasonable and appropriate administrative, technical and organizational security measures to protect Personal Information against loss, destruction, and unauthorized access or disclosure. Suppliers and vendors must apply similar protections. Users must also protect their data and systems. No technology, data transmission or system can be guaranteed to be 100% secure. If you believe your interaction is no longer secure, notify CJM immediately.
5. When CJM Shares Your Information
Information may be disclosed to:
- Affiliates and Subsidiaries for purposes consistent with this Privacy Policy.
- Service Providers for contracted services like product delivery, website hosting, data analysis, IT services, auditing, or customer service. Anonymized or aggregated information may be shared for analysis and trend identification. Our contracts with suppliers and vendors include provisions to protect your Personal Information and limit its use.
- Partners for marketing, joint products, product integration, or facilitating services. Through the affiliate referral system, if you visit through an affiliate link, we will share information about you back to the referral partner, including name, email address, and account plan.
- Advertising and Marketing partners to deliver content, personalized ads, and study campaign effectiveness. Content may be based on prior purchases, device location, viewed advertisements, or cookies. Users can change device settings regarding location sharing.

- At Your Direction or With Your Consent.
We do not share your phone number, text messaging originator opt-in data, or consent with any third parties, excluding aggregators and providers of the text messaging services.
6. SMS Communications & A2P 10DLC Compliance
When you provide your phone number through any form on our Site, you may be presented with options to consent to SMS communications. We maintain two distinct consent categories:
- Transactional SMS: Messages directly related to your engagement with us — appointment reminders, scheduling confirmations, and service-related updates. You may consent to transactional messages independently of marketing messages.
- Marketing/Promotional SMS: Messages about growth insights, new content, offers, and promotional material. This consent is separate and optional. You are never required to consent to marketing SMS to submit a form or engage our services.
Opting Out: You may opt out of SMS messages at any time by replying STOP to any message you receive. After opting out, you will receive a confirmation message confirming your opt-out. You may also contact us directly to manage your communication preferences.
Message and Data Rates: Standard message and data rates may apply depending on your mobile carrier and plan. We are not responsible for any charges incurred from receiving SMS messages.
Consent Is Not a Condition of Purchase: Providing your phone number and/or consenting to receive SMS messages is never a condition of purchasing any service from CJM. You may submit any form on our Site without consenting to SMS communications.
We do not share your phone number, text messaging originator opt-in data, or consent with any third parties, excluding aggregators and providers of the text messaging services.
7. Data Retention
Personal Information is retained for as long as reasonably necessary to fulfill the purposes we collected it for, including satisfying legal, regulatory, tax, accounting, or reporting requirements. Longer retention may occur in the event of complaints or prospect of litigation. Determining appropriate retention considers the amount, nature, and sensitivity of the information, risk of harm from unauthorized use, processing purposes, and whether those purposes can be achieved through other means. Users can request deletion; in some circumstances, we will anonymize your Personal Information (so that it can no longer be associated with you) for research or statistical purposes, which may be used indefinitely without further notice.
8. Information From Children
CJM does not knowingly collect, use, disclose, sell, or share Personal Information from children under 16. If such collection is discovered, steps will be taken to delete it promptly. If you are under 16, do not provide any information about yourself to CJM.
9. Links to Other Websites and Services
CJM is not responsible for practices of linked websites or services. This Privacy Policy does not address, and we are not responsible for, the policies and practices of third parties not operating on CJM's behalf, including any app developer, social media platform, operating system provider, wireless service provider, or device manufacturer.
10. Do Not Track
Some browsers incorporate a DNT feature. At this time, the Platform does not respond to DNT signals.
11. Your Legal Rights
CJM respects rights related to Personal Information. Depending on your location, you may have rights to access, correct, or delete personal data, and make choices about marketing materials. Jurisdiction-specific details follow below.
12. European Privacy Rights
Those in Europe may have rights under GDPR, UK GDPR, or Swiss nFADP:
- Access, Portability, Correction, or Deletion: Users may contact CJM to correct, update, access, or delete Personal Information. Some information may be retained for recordkeeping or transaction completion. At your request and where the law requires us to do so, we will confirm what Personal Information we hold about you. A processing fee may be charged where permitted.
- Right to Object to processing or request restriction by written request.
- Right to Withdraw Consent at any time, without affecting prior lawful processing or processing under other legal bases.
- Right to Complain to a local data protection supervisory authority. The UK authority is the ICO (www.ico.org.uk). Under DPF frameworks, complaints may be addressed through JAMS Mediation. Under certain conditions, you may invoke binding arbitration. CJM will respond to direct complaints within 45 days.
- Advertising and Marketing Choices: Users may access, update, or modify communication preferences. Non-marketing communications like security updates or service issues will still be sent. Some advertising uses cookies, detailed in the Cookies Policy.
13. U.S. Privacy Rights
Residents of certain states (California, Colorado, Connecticut, Delaware, Iowa, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, Virginia, and others with similar laws) have additional rights under US State Privacy Laws.
- Right to Opt Out of Sale/Share/Targeted Advertising: CJM does not sell Personal Information for money. However, certain US State Privacy Laws may consider the disclosure of information for advertising purposes to be a "sale," "share," or "targeted advertising." Opt-out is available via the website or contact methods.
- Rights to Access, Correction, and Deletion by contacting CJM. Deletion requests may require retaining certain information for recordkeeping, transaction completion, or legal compliance. Additional identity verification may be required.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your US State Privacy Law rights.
- Right to Appeal if unsatisfied with a response.
- Authorized Agent may make requests on your behalf; CJM may ask for additional verification.
- Sensitive Data: Processing is limited to uses authorized or permitted by law.
- Automated Profiling: We do not profile in furtherance of solely automated decisions that produce legal or similarly significant effects concerning you.
Categories of Personal Information collected in the past 12 months: Identifiers (name, address, IP address, email); personal information from California Consumer Records Statute (name, phone number); commercial information (purchasing histories); internet or network activity; and inferences (analytics, preferences).
Business purposes for sharing with third parties: Site Functionality, Customer Support, Business Operations, Communication, Advertising and Marketing, Analytics.
Categories of third parties for business purpose disclosures: subsidiaries and affiliates, service providers, partners, advertising and marketing partners.
Text messaging originator opt-in data and consent are excluded from all above categories and will not be shared with any third parties, excluding aggregators and providers of the text messaging services.
14. International Data Transfers
CJM is headquartered in the United States and may transfer Personal Information between the US, affiliates, and business partners in other countries, including India, in order to operate efficiently, to improve performance, and to create redundancies to protect information. Processing will meet Privacy Policy commitments and comply with applicable law.
For EEA, UK, or Swiss-originating data transferred outside those regions, CJM participates in the EU-U.S. DPF, the UK extension, and the Swiss-U.S. DPF. The Federal Trade Commission has jurisdiction over CJM's compliance with these frameworks. CJM may be required to disclose Personal Information in response to lawful public authority requests. CJM is liable in cases of onward transfers to third parties.
15. Data Privacy Framework
CJM complies with the EU-U.S. DPF, the UK Extension, and the Swiss-U.S. DPF as set forth by the U.S. Department of Commerce. CJM has certified adherence to the applicable DPF Principles. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles or Swiss-U.S. DPF Principles, the Principles shall govern. CJM agrees to notify without undue delay if self-certification is withdrawn, terminated, revoked, or invalidated, and take steps to stop and remediate unauthorized processing.
16. Privacy Policy Updates
CJM may change this Privacy Policy at any time, at its discretion. Users will be notified of changes if required by law. Your continued use of the Platform after we make changes is deemed to be acceptance of and consent to those changes, so periodic checking is advised.
